District Pass Terms And Conditions

  1. "District Pass" is a feature introduced on the District website and application under the brand name 'District' ("Platform"), available in certain cities only, i.e., Bengaluru, Delhi NCR, Mumbai, Hyderabad, Pune, Chennai, Kolkata, Jaipur, Ahmedabad, Chandigarh, Goa, Lucknow, Indore, Udaipur, Nagpur, Bhubaneswar, Dehradun, Coimbatore, Vadodara, Patna, Ludhiana, Puducherry, Bhopal, Surat, Amritsar, Agra, Kochi, Ranchi, Nashik, Jodhpur, Kanpur, Varanasi, Guwahati, Jamshedpur, Mangalore, Jalandhar, Raipur, Baddi, and Vijayawada ("Included City(ies)").

  2. These terms ("District Pass Terms") are intended to make you aware of your legal rights and responsibilities with respect to your access to and use of the District Pass. Please read these District Pass Terms carefully. By purchasing the District Pass, you are agreeing to these District Pass Terms and concluding a legally binding contract with Eternal Limited (formerly known as Zomato Limited) ("District").

  3. District Pass Membership: District Pass shall be valid for a period of three (3) months from the date of purchase of the District Pass membership ("Period"). As a member of District Pass, you will be entitled to the following benefits ("District Pass Benefit(s)"):

    (a) Discount of up to INR 500 (Indian Rupees Five Hundred only) on one ticket with every movie booking, up to a maximum of three (3) discounted tickets during the Period: This is applicable for any movie, as long as you purchase a minimum of two (2) tickets. The discount shall apply to the lowest-priced ticket in the booking and shall be capped at INR 500 per ticket. A maximum of three (3) free tickets can be availed by you during the Period. The booking charges levied for booking of movie tickets through the Platform shall be calculated on the total price of all tickets received by you, including any discounted ticket received by you as a District Pass Benefit.

    (b) 2 dining vouchers worth INR 250 (Indian Rupees Two Fifty only) each: These vouchers will be available when you pay via the Platform for dining out on orders with a minimum bill value of INR 1000 (Indian Rupees One Thousand only).

    (c) 20% discount on eligible food and beverages in cinema while booking movie tickets via the Platform: Twenty percent (20%) discount on all eligible food and beverage transactions undertaken alongside purchase of movie tickets through the Platform.

  4. You may purchase the District Pass for/in any Included City, and can use the District Pass within the geographical limits of any Included City, irrespective of the Included City you originally bought the District Pass for/in. In case you are not located within an Included City and change your location on the Platform to an Included City to purchase a District Pass, the District Pass can be used only in any of the Included Cities.

  5. You can choose to not avail a District Pass Benefit for a particular transaction, and choose to use it for a different transaction, subject to these District Pass Terms.

  6. The District Pass Benefit(s) will not carry forward, cannot be redeemed for cash, refunded, transferred or used for non-personal use.

  7. The District Pass Benefit(s) cannot be clubbed with other benefits / offers available on the Platform.

  8. If you cancel a booking, the District Pass Benefit used for that transaction will not be credited back to you. If you get a refund for cancellation by restaurants, event organisers, cinema/theatres, or any other third-party onboarded with District ("Merchant(s)"), or for booking failure or payment failure, the District Pass Benefit used for that transaction will be credited back to you.

  9. District reserves the right to charge a subscription and/or membership fee in respect of any of its Service and/or any other charge or fee on a per order level from Customers, in respect of any of its Service on the Platform anytime in future including without limitation, peak hours, very high demand, late night fee, handling charges, convenience/platform fee, small cart fee, or any other fee as may be communicated on the Platform. You shall be informed of such charges prior to making a transaction on the Platform at the stage of check-out. By making a transaction or making a booking, you agree to pay for such charges. These charges may vary from transaction to transaction, which may be determined on multiple factors such as cart value, time of the day, time taken, demand for delivery, seasonal peaks or such other parameters as may be determined from time to time. Further, District or the Merchant may from time to time offer to the customers credits, discounts, promo codes, vouchers or any other form of cashback. District and the Merchant reserve the right to modify, convert, cancel and/or discontinue the respective credits, promo codes or vouchers, as they may deem fit.

If you purchase the District Pass while completing a transaction on the Platform, the following terms and conditions shall apply to the amount paid for purchasing the District Pass:

  • In case the transaction is cancelled by you or the Merchants, you will not be entitled to any refund of the money paid for the District Pass;
  • In case the transaction is cancelled because of a payment or booking failure, you will be entitled to a refund of the money paid for the District Pass.

These District Pass Terms are subject to change, at the sole discretion of District, from time to time. District reserves the right to suspend, modify, withdraw, terminate or extend District Pass and associated District Pass Benefit(s) to you, or to all users temporarily or permanently at any time without any prior notice and without any liability or obligation in this regard, at its sole discretion. District reserves the right to terminate/suspend your District Pass membership and block you from purchasing the District Pass in the future, if District determines in its sole discretion that you (i) have violated these District Pass Terms, (ii) have been involved in activities that are in contravention of the these District Pass Terms and/or the Terms for the usage of the Platform; (iii) have engaged in non-personal use or reselling of the District Pass and/or the associated District Pass Benefit(s), or (iv) have engaged in activities which are fraudulent/unlawful/ abusive in nature while availing any of Services of District. You will not be eligible for any refund if the District Pass membership has been terminated/suspended by District for any reason whatsoever.

Any action towards availing the District Pass and using District Pass Benefit(s) is voluntary.

You acknowledge that District bears no responsibility for the compliance with statutory rules, regulations and licences by Merchants. You agree that District shall not be liable in any manner if you are unable to avail the District Pass Benefit(s) with a Merchant due to the Merchant's violation of any statutory rule, regulation and licence. District shall in no manner be liable to the member if any Merchant's outlet temporarily or permanently shuts down its operations.

You hereby agree to indemnify and keep District harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney's fee) that may be suffered by District as a consequence of (i) violation of terms of these District Pass Terms by you; (ii) violation of applicable laws; and/or (iii) any action or inaction resulting in wilful misconduct or negligence on your part.

Notwithstanding anything set out herein, District's aggregate liability for any or all claims arising from or in connection with your use of District Pass shall be limited to the membership fee paid by you at the time of purchasing the District Pass membership.

This document is an electronic record in terms of Information Technology Act, 2000, and the Rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

District may contact District Pass members via telephone, SMS or other electronic messaging or by email with information about the District Pass experience or any feedback thereon. Any calls that may be made by District, by itself or through a third party, to the members or the Merchant pertaining to the experience of a customer may be recorded for internal training and quality purposes by District or any third party appointed by District.

District may assign or transfer any of its rights or obligations under these District Pass Terms to any of its affiliates or any third party at any time.

In case of any dispute or difference arising concerning District Pass Benefit(s) or any alleged defect or deficiency of service availed, the same shall be subject to the courts at New Delhi, India.

These District Pass Terms are subject to the prevailing laws of India.

The District Pass Terms are part of and subject to the terms of service of the Platform, privacy policy and any other communication from District to you, in each case as may be amended from time to time.
